California Effort to Get a PHP – AB408 –is Paused Until 2026

Proposed legislation – sponsored by the Medical Board of California — that would establish a physician health program has been paused in its path through the California legislature. The author, Assembly person Marc Berman, has made AB408 a 2-year bill.

After hearing the concerns expressed by the chair and members of the Senate Committee on Business, Professions and Economic Development, Berman decided to step back from the process in order to consider ways to reach consensus on the concerns raised.

To learn more about the opposition to the bill and about the concerns raised by the members of the Senate Committee, see the staff analysis prepared by the Committee’s Staff Director for the Committee’s July 7th meeting. You can get the full recording of the meeting HERE. The discussion of AB408 comes up at about 1:31.

Evaluation and Treatment Programs for Physicians

There are standards developed by the Federation of State Physician Health Programs and used in the Federation’s ETA Program (FSPHP-ETA™) to accredit evaluation and treatment services that are qualified to specialize in the care of medical students, residents, career physicians, and other safety-sensitive professionals.

The standards, updated in 2024, are available for purchase. The process for purchasing a copy ($499) begins HERE. Accredited programs are listed HERE.
